Terms and conditions of vehicle hire and charter services


THESE ARE THE CONDITIONS OF HIRE OF TRANSIT SCENIC TOURS PTY LTD, (HEREINAFTER CALLED "THE COMPANY"). THEY FORM THE BASIS OF THE CONTRACT UNDER WHICH THE COMPANY AGREES TO HIRE ITS VEHICLES TO THE CUSTOMER (HEREINAFTER CALLED "THE HIRER"). BY ACCEPTING OUR QUOTE FOR YOUR BOOKING, YOU HAVE READ AND ACCEPTED THESE TERMS AND CONDITIONS AND THEY WILL APPLY TO THE BOOKING.

THESE CONDITIONS APPLY WHETHER A CONTRACT HAS BEEN MADE VERBALLY OR IN WRITING. THE HIRER IS RESPONSIBLE FOR THE ACTIONS AND DECISIONS OF ALL PASSENGERS ON BOARD AND ANY ADDITIONAL COSTS INCURRED FROM PASSENGERS.

1) BREAKDOWN AND DELAYS THE COMPANY GIVES ITS ADVICE ON JOURNEY TIME IN GOOD FAITH. HOWEVER, AS A RESULT OF BREAKDOWN OR TRAFFIC DELAYS, STAFF, WEATHER CONDITIONS, OR OTHER EVENTS BEYOND
THE REASONABLE CONTROL OF THE COMPANY, JOURNEYS MAY TAKE LONGER THAN PREDICTED AND IN THOSE CIRCUMSTANCES THE COMPANY WILL NOT BE LIABLE FOR ANY LOSS OR INCONVENIENCE SUFFERED BY THE HIRER AS A RESULT.

2) AMENDMENTS ANY CHANGES TO YOUR BOOKING MUST BE PROVIDED IN WRITING AND ARE SUBJECT TO
AVAILABILITY. AMENDMENTS MAY BE REFUSED IF LESS THAN 24 HOURS BEFORE THE BOOKING. THE COMPANY RESERVE THE RIGHT TO CHARGE AN AMENDMENT FEE OR CANCEL THE BOOKING IF THE COMPANY IS UNABLE TO PROVIDE THE NEW REQUIREMENTS. THE HIRER AGREES TO ANY NEW CHARGES IN VEHICLE CHANGE, TOLLS, PARKING AND EXTENDED HOURS.

3) LIABILITY FOR INJURY THE COMPANY WILL NOT ACCEPT ANY LIABILITY FOR DAMAGE, INJURY OR LOSS FOR ANY PASSENGER STANDING UP OR WALKING AROUND THE VEHICLE WHILST IN MOTION.

4) USE OF THE VEHICLE THE HIRER CANNOT ASSUME THE VEHICLE WILL REMAIN AT THE DESTINATION OF THE
HIRER’S USE UNLESS THIS HAS BEEN AGREED TO WITH THE COMPANY IN WRITING IN ADVANCE OF THE HIRE. HE HIRER AGREES TO ANY NEW CHARGES FOR VEHICLE WAITING TIME.

5) THE USE OF OTHER OPERATORS VEHICLES THE COMPANY RESERVES THE RIGHT TO SUBSTITUTE OTHER OPERATORS’ VEHICLES IN PLACE OF ITS OWN FOR ANY JOURNEY OR PART THEREOF.

6) PAYMENT TERMS UNLESS THE HIRER HAS AN ACCOUNT OR PAYMENT IS MADE THROUGH THE NSW EDUCATION
DEPARTMENT, DIRECT DEPOSIT OR A CREDIT CARD IS REQUIRED FOR ALL OTHER BOOKINGS. IF FULL PAYMENT IS NOT RECEIVED 3 DAYS PRIOR TO TRAVEL, IT CANNOT BE ASSUMED THE BOOKING IS CONFIRMED. THE COMPANY RESERVES THE RIGHT TO TAKE ANY FURTHER FEES OR CHARGES FROM THIS CARD.

7) CONDUCT OF PASSENGERS THE DRIVER IS RESPONSIBLE FOR THE SAFETY OF THE VEHICLE AT ALL TIMES AND AS SUCH MAY REMOVE ANY PASSENGER WHOSE BEHAVIOR COMPROMISES SAFETY. THE DRIVER HAS THE
RIGHT TO REFUSE TRANSPORT TO ANY PERSONS UNDER THE INFLUENCE OF ALCOHOL OR DRUGS, OR WHO ARE LIKELY TO BECOME DISRUPTIVE TO OTHER PASSENGERS. IF THERE IS ANY FORM OF UNACCEPTABLE BEHAVIOR ON OR OFF THE VEHICLE AT ANY TIME DURING THE HIRE, THE DRIVER HAS THE RIGHT TO TERMINATE THE HIRE IMMEDIATELY OR THE PERSON MAY BE REMOVED FROM THE VEHICLE, NO REFUND.


8) CANCELLATION BY HIRER IN AN EVENT THAT THE HIRER CANCELS A BOOKING ALL CANCELLATIONS MUST BE IN WRITING. THE COMPANY RESERVES THE RIGHT TO CHARGE A CANCELLATION FEE AS FOLLOWS.

PRIVATE CHARTERS POLICY NO CANCELLATION FEE 2 DAYS PRIOR TO TRAVEL 50% CANCELLATION FEE WITHIN 2 DAYS OF TRAVEL 100% CANCELLATION FEE DAY OF TRAVEL

NSW SCHOOLS CANCELLATION POLICY NO CANCELLATION FEE IF CANCELLED BEFORE 10AM ON THE DAY BEFORE PRIOR TO TRAVEL 50% CANCELLATION FEE IF CANCELLED AFTER 10AM ON THE DAY PRIOR TO TRAVEL 100% CANCELLATION FEE DAY OF TRAVEL


9) CANCELLATION BY THE COMPANY IN SOME CIRCUMSTANCES THE COMPANY MAY NOT BE ABLE TO OPERATE A HIRING SERVICE, OR PART THEREOF. IN SUCH SITUATIONS, THE COMPANY WILL ONLY BE LIABLE TO REFUND TO THE
HIRER THAT PORTION OF THE HIRING FEE THAT RELATES TO THE NON-OPERATED PART OF THE HIRING SERVICE, AND WILL NOT EXCEED VALUE OF THE HIRE, AND IS NOT LIABLE FOR LOSS OF MONIES PAID FOR ADDITIONAL OR SEPARATE SERVICES THAT HAVE BEEN MISSED.
IN THE EVENT THAT THE COMPANY IS UNABLE TO PROVIDE A VEHICLE OR VEHICLES TO MEET ALL OR PART OF THE HIRER'S BOOKED REQUIREMENTS DUE TO REASONS OF EMERGENCY, VEHICLE UNAVAILABILITY, OR OTHER REASON, THE COMPANY WILL TAKE ALL REASONABLE MEASURES TO PROVIDE A REPLACEMENT OR ALTERNATIVE SOLUTION.
IF THIS IS NOT POSSIBLE, THE COMPANY RETAINS THE RIGHT TO RETURN ALL MONIES PAID AND, WITHOUT LIABILITY, CANCEL THE BOOKING PROVIDING THE CUSTOMER WITH AS MUCH NOTICE AS POSSIBLE. IN SUCH CIRCUMSTANCE THE COMPANY SHALL HAVE NO LIABILITY FOR ANY INCONVENIENCE OR LOSS INCURRED AND WILL NOT BE LIABLE FOR ANY DIRECT OR CONSEQUENTIAL LOSS HOWSOEVER ARISING.

10) FOOD AND BEVERAGE THE CONSUMPTION AND OR CARRYING OF ALCOHOL ONBOARD THE COMPANY VEHICLES IS STRICTLY FORBIDDEN UNLESS PERMISSION HAS BEEN OBTAINED FROM THE COMPANY IN WRITING. FOOD AND BEVERAGE IS NOT TO BE CONSUMED IN VEHICLE AT ANYTIME WITH THE EXCEPTION OF PLAIN BOTTLED WATER.
IF PERMISSION TO CONSUME BEVERAGE IS GIVEN TO THE HIRER, A NON-REFUNDABLE FEE OF $300 WILL BE REQUIRED VIA CREDIT CARD AND IN THE EVENT OF CLEANING OR DAMAGES TO THE VEHICLE, ADDITIONAL CHARGES WILL APPLY.

11) ADDITIONAL CHARGES THE COMPANY RESERVES THE RIGHT TO IMPOSE ADDITIONAL CHARGES ON THE HIRER FOLLOWING COMPLETION OF THE HIRE IF THE PASSENGERS HAVE LEFT THE VEHICLE IN AN UNREASONABLY
UNTIDY CONDITION OR HAVING REQUIRED ADDITIONAL TIME OR MILEAGE WHICH WAS NOT INCLUDED FOR IN THE ORIGINAL BOOKING.

12) NO SMOKING POLICY HIRERS SHOULD NOTE THAT THE COMPANY OPERATES A POLICY OF NO SMOKING ON ALL COMPANY VEHICLES. IT IS ILLEGAL TO SMOKE ON ANY PUBLIC VEHICLE.

13) WAITING TIME WAITING TIME CAN BE CHARGED AFTER 15 MINS FROM THE BOOKED PICK UP TIME, ANY STOPS I.E. VIA ARE A MAXIMUM OF A 10 MINUTE STOP. ANY EXTRA TIME IS CHARGED AT $100 PER HOUR
WEEKDAYS AND $150 WEEKENDS AND NIGHTS.

14) QUOTES QUOTES ARE VALID FOR 30 DAYS AND ARE SUBJECT TO AVAILABILITY AT THE TIME OF BOOKING. UNLESS SPECIFIED TOLLS WILL NOT BE INCLUDED AND WILL BE AN ADDITIONAL CHARGE. THE HIRER RESERVES THE RIGHT TO REQUEST NO TOLL USAGE PRIOR TO THE TRAVEL DATE. THE COMPANY RESERVES THE RIGHT TO REVOKE OR AMEND QUOTES AT ANY TIME PRIOR TO A BOOKING BEING MADE.
  
15) PASSENGERS’ PROPERTY AND LOST PROPERTY ALL VEHICLES HIRED BY THE COMPANY ARE SUBJECT TO RESTRICTIONS ON CARRYING LUGGAGE FOR SAFETY REASONS. THE COMPANY WILL NOT BE RESPONSIBLE FOR ANY DAMAGE TO, OR LOSS OF, PERSONAL PROPERTY LEFT IN VEHICLES, HOWSOEVER CAUSED. ALL ARTICLES OF LOST PROPERTY RECOVERED FROM THE VEHICLE WILL BE HELD AT THE COMPANY’S PREMISES WHERE THE VEHICLE IS BASED AND WILL BE KEPT FOR A PERIOD OF 3 MONTHS.


16) GPS ALL VEHICLES ARE FITTED WITH SATELLITE TRACKING, UNLESS ORGANISED PRIOR, DRIVERS WILL TRAVEL THE ROUTE AT THEIR DISCRETION.
